Terms of Service

These Terms govern your use of swity, a service provided by SKOTY Tomasz Szykulski, a sole trader registered in Poland (NIP 5223382461), referred to below as SKOTY. Its full details are in the legal notice. By creating an account or using swity, you agree to these Terms. If you don’t agree, please don’t use the service.
1. Who can use swity
You must be at least 16 years old and able to enter into a binding agreement. If you use swity on behalf of an organisation, you confirm you’re authorised to accept these Terms for it.
2. What swity does
swity lets creators publish photo “experiences”, public web pages that visitors reach by scanning a QR code or tapping an NFC tag placed beside physical work. We provide the app, the hosting, and the tag redirects.
3. Your account
You’re responsible for your account and for activity under it. Keep your sign-in secure and let us know of any unauthorised use.
4. Your content
You keep ownership of the photos and text you publish (“your content”). You confirm you have the rights to it and that it doesn’t infringe anyone else’s rights or break the law.
To operate the service, you grant swity a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (e.g. resize for display) and publish your content solely to run and improve the service and to show your pages to visitors. This licence ends when you delete the content or your account, except for copies we must keep by law or that remain briefly in backups.
5. Acceptable use
swity is a general-audience service. You agree to follow our Community Guidelines, which prohibit, among other things, sexual or nude content, graphic violence, hateful or harassing material, illegal content (including any child sexual abuse material), and infringement of others’ rights. Don’t misuse the service, interfere with it, or attempt to access it in unauthorised ways.
6. Moderation and removal
We may review content and, where it breaks these Terms or the law, remove or restrict it, suspend or terminate accounts, and, where required, report it and preserve evidence for the authorities. Where practical we’ll tell you the reason and you may contact us to appeal (see Contact).
Every upload is checked automatically before it goes public. An automated system reviews the photos and text of a page against these Terms and our Community Guidelines before it is published. The check runs on our servers and cannot be skipped: if it does not complete, the page stays a draft rather than going live. Where the check holds something, a person makes the final decision, and you can ask us to look again from inside the app.
7. Physical tags and QR codes
You’re responsible for where you place tags and QR codes and for keeping the linked content lawful. Deleting a tag or project stops its links working.
8. Plans, subscriptions and payments
swity is free to use with a limited number of published pages. Paid plans raise that limit and remove the swity mark from your pages. What each plan includes, and its price, is shown in the app before you buy.
Subscriptions renew automatically. Plans are sold as auto-renewing subscriptions, monthly or yearly, and are billed through the Apple App Store. Payment is charged to your Apple Account when you confirm the purchase. The subscription renews for the same period at the same price unless you cancel it at least 24 hours before the current period ends, and your Apple Account is charged for the renewal within 24 hours of the end of that period.
Managing or cancelling. You manage and cancel subscriptions in your Apple Account settings, not here. Cancelling stops the next renewal; it does not shorten the period you have already paid for, and you keep the plan until that period ends. Changing between plans is handled by Apple, which adjusts what you pay for the remainder of the period.
Prices. Prices are shown in the app in your own currency and include the tax Apple collects for your country, so what you see there is what you pay. We may change prices for future periods; Apple tells you before a renewal at a higher price and asks you to agree to it.
Refunds. Apple is the seller for in-app purchases and handles refunds under its own terms. We cannot issue a refund for an App Store purchase, but write to us if something has gone wrong and we will help you make the request.
Free access. Some accounts are given a plan free for a period, or on terms agreed with us directly. Where a price applies afterwards it is shown to you in the app before it takes effect, and nothing starts charging you without a purchase you make yourself.
If a plan lapses. Nothing is deleted. Pages beyond the free limit stop being public and return to drafts, and the codes beside them stop resolving until you publish again.
9. Intellectual property
The swity name, logo and software are ours or our licensors’. These Terms don’t give you rights to them beyond using the service as intended.
10. Disclaimers
The service is provided “as is” and “as available”. To the extent permitted by law, we don’t warrant that it will be uninterrupted, error-free or secure.
11. Limitation of liability
To the extent permitted by law, SKOTY is not liable for indirect or consequential losses, or for loss of data, profits or goodwill. Nothing here limits liability that cannot be limited by law (including for death, personal injury, or intentional or grossly negligent acts).
12. Indemnity
You agree to cover reasonable losses we incur from your breach of these Terms or from content you publish, to the extent the law allows.
13. Termination
You can stop using swity and delete your account at any time. We may suspend or end access if you breach these Terms or the law, or if we stop offering the service.
14. Changes
We may update these Terms; we’ll update the date above and, for material changes, notify you in the app. Continued use after changes means you accept them.
15. Governing law
These Terms are governed by the law of Poland. Mandatory consumer protections in your country of residence still apply. Disputes are subject to the competent courts of Poland, without prejudice to your consumer rights.
